What the law requires

Regulation 36 of GSIUR 1998 requires landlords to arrange annual gas safety checks by a Gas Safe registered engineer for the appliances, fittings, and flues they provide. Existing tenants receive a copy of the gas safety record within 28 days, and new tenants receive it before moving in.

A record after every check

Regulation 36(3)(c) requires the gas safety record to list defects found during an inspection and remedial action taken. The two classifications for unsafe gas appliances are immediately dangerous and at risk, reflecting the findings recorded by the engineer.

Carbon monoxide alarms

Landlords must follow the carbon monoxide alarm requirements set out in SI 2022/707. The applicable duties depend on the regulations covering rented homes in England, as outlined in the relevant guidance.

2026 update

Section 21 ended for private landlords on 1 May 2026. The national PRS Database opens in stages from 15 December 2026, and London landlords must register by 14 October 2027.
