What Is a Gas Safety Certificate in Newham?

A Gas Safety Certificate, also called a Landlord Gas Safety Record, confirms a gas safety check. A Gas Safe registered engineer issues it after checking the gas appliances and flues a landlord provides. In Newham, 22 of the borough’s 24 wards fall within the selective licensing scheme, covering a large share of private rented homes.

Gas Safety Rules at a Glance

An annual check by a Gas Safe registered engineer under regulation 36 of the Gas Safety Installation and Use Regulations 1998.

Early renewal

A check completed during the two months before the due date keeps the original expiry date.

Tenant copies

Existing tenants receive a copy within 28 days. New tenants receive a copy before moving into the property.

Records

Keep each record until two further checks have been completed, with at least two years of records retained.

Is a Gas Safety Certificate a Legal Requirement in Newham?

Yes, for every Newham landlord who provides gas appliances. Regulation 36 of the Gas Safety Installation and Use Regulations 1998 sets the landlord duty for annual gas safety checks and the related record. Newham introduced England's first borough-wide selective licensing scheme in 2013 and now operates its third scheme. The council requires a valid gas safety certificate for licence applications and renewals.

Who Can Issue One and How to Check the Engineer

Only a Gas Safe registered engineer issues the record. Check the engineer's registration through the Gas Safe Register before work starts, including the registration details and relevant gas work qualifications. ALC also provides engineer details for customers arranging a gas safety inspection.

Why Gas Safety Compliance Works Differently in Newham

Newham introduced England's first borough-wide selective licensing scheme in 2013. The borough now runs its third five-year scheme across 22 of 24 wards, from 1 June 2023 to 31 May 2028. The council reported around 70% of London's rogue landlord prosecutions in one year. Five things make gas safety compliance in Newham different.

What Makes Newham Gas Compliance Different

Newham's licensing history and property landscape create several local factors for landlords:

1

First borough wide scheme

Newham introduced selective licensing across the borough in 2013 and now runs its third scheme.

2

22 of 24 wards

The current scheme covers 22 wards from 1 June 2023 to 31 May 2028.

3

Large licensing scale

More than 30,000 licences have been issued under the current scheme.

4

Strong enforcement

The council reported around 70 percent of London's rogue landlord prosecutions in one year, with 1,225 prosecutions and 28 landlord bans.

5

East Village

E20 includes 2,818 homes, with privately rented properties alongside homes managed by a housing provider.

Newham Licensing Facts

How Gas Safety Checks Work for Newham Landlords

Getting the Certificate Ready for an Application or a Renewal

Get the gas safety record in place before submitting a licence application or renewal. The record needs to be current at both points. Keep the PDF retrievable, as the council can request a copy within 28 days. For a boiler installed less than 12 months ago, a Gas Safe Installation Certificate can serve as the alternative record.

One Flat Inside a Large Managed Development

At East Village and other large E20 and Royal Docks developments, individual landlords can own single leasehold flats inside managed blocks. The landlord still holds the gas safety duty for appliances inside their own flat under regulation 36. Landlord gas safety checks Newham properties require the same attention to appliances and flues within the rented flat.

Annexes, Outbuildings and Converted Spaces

A space used as living accommodation and containing a gas appliance falls under the same annual gas safety duty. An annexe or outbuilding does not become exempt because of its location or layout. Gas safety certificate services in Newham also cover these rented spaces where gas appliances are provided.

STEP 4

What's Checked on a Newham Gas Safety Check and What Isn't

A Newham gas safety check covers the landlord provided appliances, their flues, operating pressure, combustion readings, ventilation and safety controls. Installation pipework has a separate maintenance duty.

Covered by the gas safety check

NOT covered by the annual check

Gas appliances the landlord provides
A tenant's own gas appliances
Flues and chimneys serving those appliances
A full boiler service
Appliance operating pressure and heat input
Repairs or replacement parts
Combustion performance and flue gas readings
Installation pipework
Ventilation to each appliance
Electrical safety, covered by an EICR
Safety devices and flame supervision
Carbon monoxide alarm supply

If the Engineer Finds a Defect

The engineer classifies a fault as Immediately Dangerous or At Risk and records the finding on the gas safety record. With permission, the engineer can disconnect an unsafe appliance. The record is still issued and lists the defect found. Any remedial work is quoted separately from the gas safety check.

Pipework and Carbon Monoxide Alarms

Installation pipework is separate from the annual gas safety check and remains a continuing maintenance duty. A tightness test and visual examination are recommended good practice, and ALC carries these out. A carbon monoxide alarm is required in living accommodation with a fixed combustion appliance, except a gas cooker, under SI 2022/707 from 1 October 2022.

Gas Safety and Property Licensing in Newham

Newham's selective licensing scheme covers 22 of 24 wards from 1 June 2023 to 31 May 2028. Additional HMO licensing operates across the borough, alongside mandatory HMO licensing for properties with five or more people from two or more households. The gas safety record forms part of the licence file and does not grant the licence.

What the Law Requires

Regulation 36 requires an annual gas safety check on landlord provided appliances and flues by a Gas Safe registered engineer. Keep the record until two further checks are complete, with copies given to tenants within the required timescales.

Applying and Renewing

The council requires proof of valid safety certificates when you apply for or renew a property licence. Keep the record current at submission and retrievable for a council request within 28 days. A Gas Safe Installation Certificate can apply to a boiler installed less than 12 months ago.

2026 Update: Section 21 and the Landlord Register

Section 21 ended on 1 May 2026 under the Renters' Rights Act 2025, leaving Section 8 as the possession route. The national Private Rented Sector Database opens for landlord registrations on 15 December 2026.

Newham Property Types We Cover

Terraced Houses and Converted Flats

East Ham, Forest Gate, Plaistow and Manor Park have many older terraced homes and converted flats. Each rented unit needs its own gas safety record for the appliances and meter provided with that let. Homes with several gas appliances need each appliance listed separately on the record.

HMOs and Shared Houses

Newham's additional HMO licensing scheme operates alongside selective licensing. Every landlord-provided gas appliance across rooms and shared kitchens needs to appear on the gas safety record. Keep the record ready for a council request within 28 days. An HMO fire risk assessment covers separate property safety requirements.

Flats in Large Managed Developments

East Village in E20 and the Royal Docks contain large managed developments with individual leasehold owners. If you let one flat, the gas appliances inside that flat remain your responsibility under the regulations. The building operator's arrangements do not transfer that duty to the individual flat owner.

Flats Above Shops and Mixed Use

Newham's high streets and parades include homes above shops and other commercial premises. A domestic CP12 covers the residential let, and its landlord-provided appliances. Gas equipment serving a shop or restaurant below falls outside that domestic record and needs separate non-domestic attention.
